Terms of Service

The Celebrant Agrees To:

Compliance with Legislation:
The Celebrant will adhere to the Code of Practice for Commonwealth-authorised marriage celebrants and provide copies of required documents, including the Happy Ever After and Celebrant’s Code of Practice.

Conducting the Ceremony:
The Celebrant agrees to attend and conduct the ceremony at the agreed date, time, and place.


Substitute Celebrant (if needed):

In case the Celebrant is unable to conduct the ceremony, they will notify the Parties and take reasonable steps to arrange for another registered celebrant to officiate.

The Parties Agree To: 

Payment of Fee:

The Parties agree to pay the Celebrant’s fee as outlined in the attached invoice. The fee includes:

Unlimited contact via email and phone

Up to two meetings

Editing and revisions of ceremony script

Completion of all required legal forms (e.g., NOIM, Statutory Declarations)

Ceremony conduct and paperwork (e.g., Marriage Certificate, lodgement)

Travel expenses for the celebrant (as applicable)

Providing Documentation

The Parties agree to provide all necessary original documents, including identification (passport, birth certificates, and photo ID), at least 7 days prior to the ceremony. This includes any required translations for documents, as needed.

The NOIM (Notice of Intended Marriage) must be lodged no later than 30 days and no earlier than 18 months before the ceremony.


The DONLIM (Declaration of No Legal Impediment to Marriage) should be completed as close as possible to the wedding date.

Failure to Provide Documentation:

If the Parties fail to provide required documentation 7 days prior to the ceremony, the Celebrant may decline to attend or conduct the ceremony.

Ceremony Details:

Changes to Ceremony Details:
If there is a change to the time, date, or location of the ceremony, the Parties agree to notify the Celebrant immediately. The Celebrant reserves the right to terminate the agreement and retain the deposit if the change prevents them from attending.

Medication or Special Requirements:
If either party is taking medication that may affect their demeanor during the ceremony, they must inform the Celebrant as soon as possible.

Cancellation:
If the ceremony is canceled, written notice must be provided to the Celebrant. The Celebrant reserves the right to retain the booking fee or deposit and any other amounts paid.

 

Late Arrival or Non-Arrival:
If both parties have not arrived or the ceremony cannot proceed due to reasons beyond the Celebrant's control, the Celebrant reserves the right to leave the venue 45 minutes after the scheduled start time.

Equipment:

PA System:
The Celebrant will use their own high quality PA system for delivery of the ceremony.  The Celebrant will arrive 30 minutes prior to guest arrival to conduct a sound check and ensure everything is in working order. 

Undertakings:

Accurate Information:
The Parties agree to provide accurate information and acknowledge that providing false information may result in penalties under the law.

Inability to Solemnise Marriage:
If the Parties appear to be under the influence of alcohol or drugs, the Celebrant has the authority to decline solemnising the marriage.

  • This judgment is solely at the Celebrant's discretion.

  • Witnesses must also appear sober and be at least 18 years of age. The Celebrant has the right to request alternative witnesses if necessary.

Social Media & Marketing:

Photographs:
Photographs from the ceremony may be used by the Celebrant for marketing and social media purposes, unless otherwise agreed in writing.

Supplier Recognition:
The Parties agree to provide the Celebrant with a list of their suppliers so that the Celebrant can credit them on social media, supporting local businesses.

Agreement Binding:

By proceeding with the booking and utilising the services of Kate Moody Celebrant, the Parties acknowledge and agree to the terms and conditions outlined in this Agreement. This agreement becomes binding once the Parties engage the Celebrant’s services, whether via email, phone, or other communications.

Acknowledgment:

By proceeding with the booking process or requesting services from Kate Moody Celebrant, the Parties confirm that they have read, understood, and agreed to the terms and conditions as set out in this Agreement.
